In the world today, there has been a new phenomenon of countries interdependence of one another due to globalization Nations rely on each other economically and politically, which creates a great need for International Law. International Law is a body of rules that binds states and other agents in world politics and is considered to have the status of law. International Law is essential to the peaceful interactions between nations due to the body of rules that binds states and other agencies together.
This essay will analyze key components of international law and how they affect international relations International laws are established and followed because of the incentive of cooperation between states, States are in constant negotiations with each other and a set of international laws are imperative. According to the text, World Politics, there are two distinct ways in which international law can be made. The first was international law can be made is through customary international law: accepted practice, that is carried out by states based on a subjective belief that an action is a legal obligation.
This process is often lethargic, but over time states recognize that such practices are appropriate. The second way an international law can be made is through a treaty a treaty is is negotiated and ratified by the states and typically has a faster success rate. International laws give states the opportunity to bargain with one another on a equal playing field. International law gives tremendous incentive because of the cooperation with other nations.
When a nation does not cooperate how does a nation enforce the agreement? In fact, most of international agreements entail no provisions for enforcement. However, there are several ways in which a country can enforce an agreement. One way is through the use of tariffs and the use of quotas to limit the goods of the foreign nation, while these strategies have a negative effect on their own consumers, these tactics can hurt the opposing nation economically.
Along with such sanctions, the WTO can also play a role in enforcement Although, the WTO cannot punish offenders themselves, the organization can permit victims of violation of international can retaliate by imposing duties on goods purchased. This allows victims to be able to retaliate with the backing of a powerful organization in order to reach equality in the international markets International norms differ from international laws because norms rest on a community’s belief about what is right rather than the law. International norms are standards of behavior for actors with a given identity norms define what actions are “right” or appropriate under particular circumstances. Norms consist of several things in international affairs but norms are usually only identified when they’re violated for example, before WWII there was no written code about the use of nuclear weapons.
The violation of these norms were brought to the attention during WWII when the United States dropped two nuclear bombs on Japan, Norms allow fluent and peaceful interactions but when such norms are violated there could be cause for great tension between nations. When tension arises it gives an opportunity for other actors to take advantage of the situation. Although, international norms are not written down such as international law, it proves to be a costly consequence is violated International laws and norms protect individuals within an international agreement. The goal of the agreement is to provide fairness and equality to the parties involved. However, in many cases, each party involved is not treated fairly, the transnational advocacy network allows the individuals who are not given a voice a venue to protect themselves. Transnational advocacy network is a set of individuals and nongovernmental organizations acting in pursuit of a normative objective TANs objective includes tackling many issues within the international arena, such as human rights, environment, women’s rights, peace, global justice and several other issues.
TANs attempts to alter unjust policies and regulations by making individuals more aware. The belief of is that is TANs can make more people aware of the issues around them there will create public pressure for change. TANs plays an important role on putting pressure on states, similar to the effects of the boomerang model. The boomerang model was created by Margaret Keck and Kathryn Sikkink in order to combat injustices of governments against NGOs. The boomerang model is a process in which NGOs in one state are able to activate transnational linkages to bring pressure from other states on their own government. This is most effective when NGOs are unable to influence the decisions of the government.
The boomerang model has shown to be more effective today with the use of social media the boomerang model creates change by putting public pressure on governments. Although, NGOs have less power than governments it gives them a playing field in bargaining, Thousands of years ago the most common form of international interaction was warfaret through the development of international law, international norms, transnational advocacy networks and the boomerang model the most common form of interaction today is trade. The world today is a giant marketplace, where with a click of a button a transaction can be made from across the globe. With the use of international laws and more, international interactions today, will show great cooperation, fairness and prosperity.
