The bill which was approved by Governor Jerry Brown was approved by both him and the Secretary of state back in September 2018.

This is a perfect example of the state government taking action in order to pass certain laws with their power. The bill states the prohibition of full-service restaurants from providing plastic straws unless they are requested. In the San Diego Union-Tribune, they stated California’s definition of a “full-service restaurant” is an “establishment with the primary business purpose of serving food, where food may be consumed on the premises”.

They went into more detail of the restaurants, where the customer has to be escorted or assigned to a seating area, where also their order has to be taken in that same area, and their order has to be brought to them and finally the check has to be delivered to the customer in the eating area.

According to the Los Angeles Times, they mentioned in a study they estimated Americans use 172 million straws each day and we dispose of more than 33 million tons of plastic in 2014, in which it wasn’t recycled. Plastic pollution is a huge threat to our oceans, waterways and landfills. It can harm marine animals, contaminate the human food supply and can lead to contamination of drinking water. Thankfully by passing this law, reducing consumer demand for plastic straws can help decrease plastic pollution. Due to this being passed, society has seen the benefits of not using straws in their everyday lives, to an extent where there has been a big movement on social media. The movement is known as #SaveTheTurtles, in which consumers buy metal or paper straws to use less plastic in order to save the marine life. In the end this law will highly benefit California and also the oceans and marine life, by making it a cleaner and less polluted environment that affects everyone.

The 2019 California law that went into effect January 1, 2019 will make DUI offenders take more responsibility for their actions. This new law requires DUI offenders to install an ignition interlock device into their cars whether it be their first or repeated offense. An ignition interlock device measures the amount of alcohol in a driver’s breath and prevents the car from starting unless the driver is sober (“your central valley”, 2018). This is the only way that offenders will be able to obtain their driving privileges back quickly. This law was put in place to help protect people on the road from drunk drivers.

The ignition interlock device (IID) program will be in effect until January 1, 2026 and may extended if it’s effective. The program was first tested in four counties including Alameda, Los Angeles, Sacramento, and Tulare and was expanded to the entire state of California. From having to wait a mandatory suspension period to obtain a restricted driver’s license, eligible individuals can obtain one quickly by installing an IID into their cars. An IID requires multiple clean and rolling breaths in order for a vehicle to start. Any actions that don’t comply with the rules and laws for having an IID will be recorded such as breaths that test positive for alcohol, tampering of the device, and getting another person or object to take the test on your behalf. A DUI driver with a first offense will have to have an IID installed for six months. A second, third, and fourth or subsequent offense will require an IID for one, two, and three years respectively. The DUI offender is responsible for the costs of the device which consists of installation and maintenance with a monthly cost up to $80.

4. Argue if the group believes that this law will or will not benefit California.

The group believes that this law will be beneficial for California. There is a significant amount of people that continue to drive while intoxicated despite how dangerous and fatal it can be to themselves and other people. Not only were the arrest rates increasing from drunk drivers, but deaths rates were rising as well. The arrest rate in 2017 consisted of 917 people compared to more than 1,100 people in 2018; and the death rate consisted of 27 fatalities in 2017 compared to 47 in 2018 (Self, 2016). The death rate in California kept increasing dramatically and something had to be done to make a change and decrease these rates. As the national rate of alcohol-impaired driving fatalities is 10,874 (“State Map”, 2019), it’s clear that California holds a huge portion of this total. This law will keep Californians from driving while intoxicated, and let violators continue to drive to and from their destinations while keeping people safe on the roads. All the costs and inconveniences that come with having an IID installed in a vehicle will discourage individuals from repeating the offense; and prevent others from committing the crime at all.

SB-1192 regulates the drinks being distributed to children by setting their default drinks to natural and healthy choices. This law was made to reduce obesity in the number of children in California.

The bill first came about when there was a significant increase to obesity in California by 250% from the year 1990-2016. Lawmakers carried a desire to prevent obesity and anything that could risk a decline in health amongst the people as that could result in “serious economic costs.” (Lardieri, 2018) Lardieri includes a point in which many families tend to eat out because they are short of time to buy and/or prepare healthy meals at home. Therefore, the idea of eating out becomes more apparent and acceptable. However, the issue is that children consume double the calorie intake as compared to eating a home cooked meal; which can result in many problems regarding obesity. So, in hopes of putting a stop to obesity, SB-1192 was implemented stating that children’s meals must offer healthy alternatives such as:

? Flavored water with no added artificial flavoring

? Nondairy milks that contain no more than 130 calories/serving

The group believes that this law will benefit California. If we were to allow restaurants to serve unhealthy drink in kid’s meals, children would grow up thinking it’s okay and that all restaurants are meant to be unhealthy. Especially, eating with our families contributes to our diets and we’re more prone to stay in the habit of eating how we were taught to eat as children. Stanford Children’s Health says in their article Why the Family Meal is Important, “Eating together tends to promote more sensible eating habits, which in turn helps family members manage their weight more easily.” So, if families with children have no other choice but to eat out, the children can grow up learning how to manage their health. It is important that we establish certain rules during our youth so that we can prevent self-deprecating outcomes of our later lives.

SB- 946 Helps sidewalk vendors from not being criminalized; cities and counties can establish certain control that is directly related to objective health, safety, or welfare concerns.

This law protects street vendors from being stopped from selling their products whether it’s in parks, or specific places determined by the city. Under SB 946, local authorities may establish time, place, and manner restrictions on sidewalk vending. Under the Sidewalk vendors law, a local authority may not charge criminal penalties, like misdemeanors or infractions, for sidewalk vending violations. Also, a local authority cannot cite, fine, or prosecute a sidewalk vendor for a violation of any rule or regulation that is conflicting with SB 946. This law also allows anyone currently or previously prosecuted for a sidewalk vending violation to have a pending prosecution, sentence, fine, or conviction dismissed.

4. Argue if the group believes that this law will or will not benefit California.

As a group we believe that this law will be highly beneficial not only to California, but possibly inspire many other states as well. With this law many people in Los Angeles and other places will be able to sell their goods to the public without the fear of getting a crazy fine, harassed, arrested, or even deported. These men and women can continue to support their families, as many of them are of low-income status and this is the only job that they find adjustable and reliable for them. And as, ELACC’s statement points out, “With the Governor’s signature now thousands of sidewalk vendors across the state will be able to provide for their families without fear, especially our Women Vendor leaders that are at the forefront of this movement,” said Isela Gracian, President of East LA Community Corporation. With this being said many people can peacefully continue with their jobs without fear, and especially for women who already have it hard finding a job where they can manage their own hours and take care of their household.
