This day of October 31, 2018 between Carl Winslow, presently residing at 1516 Wrightwood Avenue, hereinafter sometimes referred to as “the Husband,” and Henrietta Baines-Winslow, presently residing at 1516 Wrightwood Avenue, hereinafter sometimes referred to as “the Wife.” Witnesseth: Whereas, the parties are husband and wife and were married in Cleveland Heights, on March 4, 1999. Whereas, there are three children of the marriage, namely a son named Edward Winslow, hereinafter referred to as “Eddie,” born on July 8, 2003, a daughter named Laura Winslow, hereinafter referred to as “Laura,” born on December 14, 2005, and a daughter named Judy Winslow, referred to as “Judy,” born on September 1, 2007 and Whereas, in consequence of disputes and irreconcilable differences, the parties have separated, and are now living separate and apart, and intent to continue to live separate and apart for the rest of their natural lives;
Whereas, the parties desire to confirm their separation and make arrangements in connection therewith, including the settlement of all questions relating to their property rights, the custody of their children, (which the parties recognize as paramount), and other rights and obligations growing out of the marriage relation; Now, Therefore, in consideration of the premises and of the mutual covenants and undertake g herein set forth, the parties covenant and agree as follows: Separation 1.
The parties may and shall at all times hereafter live and continue to live separate and apart for the rest of their natural lives.
Each shall be free from interference, authority and control, direct or indirect, by the other as fully as if he or she were single and unmarried.

Subject to the provisions of this agreement, each may reside at such place or places as he or she may select.
The parties shall not molest each other or compel or endeavor to compel the other to cohabit or dwell with him or her, by any legal or other proceedings for the restoration of conjugal rights or otherwise. Debts 2. The Wife states that she has not incurred or contracted, nor will she at any time in the future incure or contact, any debt, charge or liability whatsoever for which the Husband, his legal representatives, or his property or estate is now or may become liable, and the wife further covenants at all times to keep the Husband free, harmless and indemnified of and from ant any and all debts, charges and liabilities heretofore and hereafter contracted by her. Husband shall pay all the following debts and will not at any time hold Wife responsible for them: A. The rest of the mortgage owed on their house through Wells Fargo totaled at $85,000.00.
The rest of the second mortgage through Fifth Third Bank in the sum of $28,000.00 Mutual Release 3. Subject to the provisions of this agreement, each party has remised, released and forever discharged and by these presents does for himself, and his or her heirs, executors, legal representatives, assigns, administrators, remise, release and forever discharge the other of and from all cause or causes of action, claims, rights or demands whatsoever, in law or in equality, which either of the parties hereto ever had or now has against the other, except any or all cause or causes of action for divorce. Waivers of Claims against Estate 4. Subject to the provisions of this agreement, each of the parties may in any way dispose of his or her property of whatsoever nature, real or personal, and each of the parties hereto, for herself or himself, and for her or his heirs, legal representatives, executors, administrators and assigns, hereby waive any right of election which he or she may have or hereafter acquire regarding the estate of the other, or take against any last will and testament of the other, whether heretofore or hereafter executed, and renounces and releases all interest, right or claim of right dower.
Or otherwise, that she or he now has or might otherwise have against the other, on the property of whatsoever nature, real or personal , of the other, under or by virtue of the laws of any State or country, and each will at the request of the other, or his or her legal representative, executors, administrators, and assigns, execute, acknowledgement and deliver any and all deeds, releases, or any other instruments necessary to bar, release or extinguish such interest, rights of claims, or which may be helpful for the proper carrying into effect of any of the provisions of this agreement. Each of the party’s renounces and relinquishes any and all claims and rights that he or she may have or may acquire to act as executor or administrator of the other party’s estate. Division of Personal Property. The parties have consequently divided their personal property to their mutual satisfaction. From now, each of the parties shall own, have and enjoy, independently of any claim or right of the other party, all items of personal of every kind, nature and description and wheresoever situate, which are now owned or held by or which may hereafter belong or come to the Husband or Henrietta Baines-Winslow, with the full power to the Husband or Henrietta Baines-Winslow to dispose of the same as fully and effectually, in all respects and for all purpose, as if he or she were unmarried.
Husband transfers to wife as her sole and separate property: Wife’s heirloom jewelry. The balance on their credit cards from Macy’s totaling in $1,250.00, their discover card totaling $7,500.00, and their Capital One Visa totaling at $11,000.00. All of the household furniture and furnishing except the painting by Sharon Jordan Bosh valued at $65,000.00. Wife’s 401 (k) savings plan through Macy’s currently valued at $7,587.94. Wife transfers to Husband as his sole and separate property: Their 5-year-old Bushong dog named Puff. B. Baseball collection that includes a TOPPS Mickey Mantle Rookie card currently valued at $58,499.00. The panting by Sharon Jordan Bosch currently valued at $65,000.00. Husbands pension plan benefits earned during their marriage presently valued at $156,742.00. Custody of Children 6. Henrietta Baines-Winslow shall have sole custody of Eddie, Laura, and Judy, except that the husband may at his option have the custody of either or any, concurrently or at different or over-lapping periods, as follows: Every Tuesday, Thursday, and every other weekend after 3:00 P.M when the Husband gets off work; and Every other Christmas, Easter, and Thanksgiving and shall return home the next day after the holiday has occurred; and May take two vacations a year with the Husband for no longer than 7 days.
The Husband shall exercise his option by notifying Henrietta Baines-Winslow in writing of his intention so to do at least 60 days before the beginning of any such period referred to in subparagraph of paragraph 6. The husband has the right to meet up with the children at any reasonable time upon notice, and Henrietta Baines-Winslow shall allow the Husband opportunity to do so The parties shall consult with each other with respect to the education and religious training of the children, their illnesses and operations (Except in emergencies), their welfare and other matters of similar importance affecting the children, whose well-being, education and development shall at all times be the paramount consideration of the Husband and Henrietta Baines-Winslow. It is the Husband’s intent to exercise the right of custody each year and from time to time, but the Husband’s custody as provided in subparagraph 6 shall be entirely optional with him and his waiver of his high right to insist thereafter upon compliance with the provision of thereof.
The parties shall exert every reasonable effort to maintain free access and unhampered contact between the children and each of the parties, and to foster a feeling of affection between the children and the other party. Neither the Husband nor the Henrietta Baines-Winslow shall have the right to take or send the children outside of the continental territorial limits of the United States of America without obtaining the prior written consent of the other. Support of Henrietta Baines-Winslow and Children. If the Wife has not remarried (should the parents be divorced), the Husband shall make the following payments per month to the Wife for her life and for the support and maintenance of the Wife and for the support, maintenance and education of the children: Henrietta Baines-Winslow: $600.00 Children: $300.00 per child Husband shall also continue to pay the health insurance for the children. Wife’s Counsel Fees. The wife will pay her own counsel fees and legal expenses of the Wife in connection with negotiation and preparation of this agreement. Acceptance and Release by Henrietta Baines-Winslow.
Henrietta Baines-Winslow recognizes and acknowledges that the foregoing provisions for her benefit are satisfactory and that they are reasonable and adequate for her support and maintenance, past, present, future and in keeping with her accustomed ways of living. Henrietta Baines-Winslow accordingly releases and discharges Carl Winslow for the rest of her life from any and all claims of demands, past, present and future for alimony or for any provision for maintained and support except as contained in this agreement. Subsequent Divorce 10. In the event that an action for divorce is instituted any time hereafter by either party against this or any other state in the country, the parties hereto agree that they shall bound by all terms of this agreement shall not be merged in any decree judgement that may be granted in such but shall be forever binding and conclusive on the parties and nothing herein contained shall be construed to prevent the decree of judgement in any such action from incorporating in full or in substance the terms of this agreement. Entire Agreement .
Both the legal and practical effect of this agreement in each and every respect and the financial status of the parties has fully explained to both parties by their respective counsel and they both acknowledge that it is a fair agreement and is not the result of any fraud, duress, or undue influence exercised by either party upon the other or by any other person or persons upon either, and they further agree that this agreement contains the entire understanding of the parties. There are no promises, warranties, undertakings, or covenants other than those expressly set forth herein. Additional Instruments 12. Each of the parties agrees further at any time and from time to time make, execute, and deliver all instruments necessary to effectuate the provisions of this agreement.
For the purpose of this agreement, all notices or other communications give or made hereunder shall, until further notice, be given or mailed to the Wife at 1516 Wrightwood Avenue Cleveland Heights, OH 44106 and to the Husband at 8683 Lake in the Woods Trail, Chagrin Falls, Ohio, 44023. Each party will at all times keep the other party informed of his or her place of residence and business and will notify the other party of any change in a promptly manner, giving the address of any new place of residence or business. Situs. All matters affecting the interpretation of this agreement and the rights of the parties hereto shall be governed by the laws of the States of Ohio. Binding Effect. All the provisions of this agreement shall be binding upon the respective heirs, next to kin, executors, assigns of the parties, and administrators hereto. Counterparts 16. This agreement shall be executed in triplicate, each of which is so executed shall be deemed an original and shall constitute one and the same agreement.
