In New York City, a proposal was made for the legalization of the practice of subrogation. This has ignited the debate even for feminist leaders, common citizens, and LGBT rights defenders. This issue has questioned the state of New York as a progressive leader.

The bill has the support of the mayor of the city Andrew Cuomo, however, this was not enough since several legislators have expressed their opposition.

Feminist leader Gloria Sein wrote a letter to the mayor, stating that this industry damages and endangers women in the process, especially those who have few or no economic alternatives. At the moment the law that governs the ‘contract of surrogate mothers’ is punishable by a fine and it is considered contrary to the public policy of the state of New York.

Nevertheless, the state is divided by representatives of LGBT rights, assembly members, medics, academics, and activists. Who claims that the restrictive law against subrogation is archaic and forces couples who wish to have children this way to leave the state to be able to become parents. Senator Brad Hoylman states that this bill will mark equality rights for the LGBT community, himself is a parent of two children that were conceived by surrogacy in the state of California.

Should, maternity be paid over? The aforementioned legislator, Deborah Glick has expressed that it is alarming the commercializing of the woman’s body to satisfy the desire of the wealthiest. “According to the Columbia Law School, the costs of surrogate pregnancy in the United States range from $ 20,000 to $ 200,000” (New York Times, June 12, 2019).

My reaction to this ethical issue in the article ‘Battle Over Paid Surrogacy in New York Pits Progressives Against Feminists.’ dealing with paid subrogation is my position against the proposal. In my opinion, I feel that the practice violates the rights of women by using them as an object of gestation of children for third parties. People who make use of this option turn to women with limited resources, which forces women to accept money in exchange for the commercialization of their womb. The regulations aim to normalize the idea that women are used as instruments of others regardless of their feelings without caring if their lives are at risk, what happens next to the woman’s life during postpartum?. The woman who accepts these types of contracts is subject to psychological disorders and even life-long trauma. Although the woman agrees that she should disassociate herself from the baby, in the course, it is possible that she develops her maternal instinct and this causes a ‘complication’ for those involved. And even prospective parents submit themselves to uncertainty, anguish, stress, and moral/ethical conflicts because they are paying for a “service”.

On the other hand, I understand the desire of many couples that want to have children and not be able to realize their dream. However, I consider that there are alternatives, such as the adoption of children who yearn for the same as these couples, to have a family and a home where they can be loved. In the mentioned article ‘Battle Over Paid Surrogacy”. It is estimated that the cost of surrogacy is quite high, the question is at what cost we are buying the life and happiness of a human being. A transaction where babies are a lucrative business.

In conclusion, behind surrogacy, many psychological, ethical and legal aspects are hidden. I strongly believe that women cannot be commercialized, be subjected to the suffering of giving up their offspring and reproductively exploited to satisfy the wishes of others. The problem lies at the instant where this culture empowers the economically privileged and ends up in the violation against the life of the creatures and their biological mothers.
