Abstract

I will attempt to develop a information paper to address the ramifications of the department of homeland security jurisdiction, mission, and responsibilities. I will also try and analyze hazards whether manmade or technological, and naturally occurring both domestic and foreign hazards and terrorism. I have been appointed an action officer at my local jurisdiction office of homeland security. This office was created by the mayor as a medium size jurisdiction. The city manager’s office includes dual responsibilities in most of the management positions.

Our chief of police has been assigned as director of Homeland Security for our city or region.

Hazards and Threats

Everyday Americans face some type of attack. Most often not heard in the daily news, but these attacks are real. We face attacks to our infrastructure which is our basic structure. For an example; our buildings, roads, and power supply these are just a few things that are affect once an attack happens. These are things as a society that we need in order to operate.

A threat on American becomes a threat on Americans. Legal Hazard most often refers to laws and regulations that are forced by companies such as insurance companies to cover the risk. The terms that we associate with lost is peril, risk and hazard these terms often go hand in hand. A risk is considered to be a chance at lost or possibility of loss and peril is a cause for lost and hazard is thought to increase the possibility of lost.

For an example a house fire is a cause of peril because it represents lost. On the other hand hazard almost always increase the likelihood or probability of loss.

Legal Basis

The legal basis for the current Department of Homeland Security is that “the Committee on Homeland Security and Governmental Affairs has three sources of jurisdiction: Senate Rule XXV (k); Section 101 of S. Res. 445 (108th Congress); and. The Committee’s funding resolution. ). The jurisdiction of the Committee on Homeland Security and Governmental Affairs in this paragraph shall supersede the jurisdiction of any other committee of the Senate provided in the rules of the Senate: Provided, That the jurisdiction provided under section 101(b)(1) shall not include the National Flood Insurance Act of 1968, or functions of the Federal Emergency Management Agency related thereto.

Missions of DHS

The Department of Homeland Security provides the team work and, quick response to a terrorist attack, natural disaster or any other unwelcomed and unnatural threat to the country. DHS works with federal, state, local, and private sector entities to ensure a swift and safe and effective recovery process. The Department of Homeland Security is charged to ensure the security, safety and well-being of the United States from both man-made, natural disasters, and terrorist activity. Homeland Security Advisory System is something like the management broadcasting station that comes on our televisions which states “this is a test of the management broadcasting station if this had been an actual emergency we would notified you were to tune in for further information.” In other words The Homeland Security Advisory system protects public safety and all government officials of danger or threat to the country.

DHS Responsibilities

The United States Department of Homeland Security (DHS) is a federally owned agency prompted with the task to protect the United States against attacks by terrorist, and also threats and natural disasters. The large task and duties include air traffic control, security, border control, and emergency response and cyber-attacks. The ultimate goal of the department is to sustain life from disastrous situations. There are offices within the DHS that help make ciaos seem mild and they are the Federal Emergency Management System which provides real-time analysis of what is happening to first responders. Congress enacted the DHS responsibilities after 911.

Hazards

Hazards are defined as a danger or risk. There are different types of hazards for instance physical hazard which results from slippery floors i.e. “She broke her ankle as a result for the floor being wet”. Another un-safe hazard to consider is misused machinery, chemical gases, dust, fumes all considered combustible and dangerous. Any hazard that can cause harm to wild life, the environment, or human life is dangerous. Materials in labs are also considered hazardous. Things like flammable liquids, such as acetone, solvents, waste inks, gas, oil and some dry cleaning products. OSHA has deemed certain things we use every day as hazardous materials such as old batteries, nail polisher remover, shoe polish or toilet bowl cleaner these are all considered toxic.

Domestic and Foreign Terrorism

How do Federal regulations define terrorism? It is a code that states “any type of unlawful use of violence or force to intimidate a government or the civil population because of social or political gain is considered terrorism. Any violation in which a person engages in an act to do harm to human life is a violation to the laws of the United States. Terrorism will not be tolerated and it is a direct threat to our population. Whether coerced or intimidating to affect the overall conduct of a government is considered a form of terrorism. Foreign Terrorism is any act of violence towards the United States by any individual who lives outside the United States and threatens our U.S. homeland. An example of this would be the most deadly terrorist attack on U.S. soil in history the 911 world trade center attack where it is estimated that nearly 3000 people lost their lives. This attack was believed to be carried out by Osama bin Laden and his al-Qaeda organization.

North Carolina Hazards

North Carolina state laws are thoroughly and clear about what is considered hazardous. The state I currently live, i.e., North Carolina, have a right to know policy; which outlines where chemical risk are. The Chemical Accident Prevention Program relies on the requirements that are already set forth in the Emergency Planning and Community Right-to-Know Act (EPCRA). These facilities are able to provide information about yearly releasing toxic chemical in an effort to keep everyone up to date on the new strains

North Carolina Terrorism

North Carolina defines terrorism as in Article 3A as an act of violence’ means a violation of G.S. 14-17; a felony punishable pursuant to G.S. 14-18; any felony offense in this Chapter that includes an assault, or use of violence or force against a person; any felony offense that includes either the threat or use of any explosive or incendiary device; or any offense that includes the threat or use of a nuclear, biological, or chemical weapon of mass destruction.

Conclusion

The DHS (Department of Homeland Security) sole responsibility is to protect and secure the United States homeland. This means anything manmade, natural or hazardous. The Department of Homeland Security is a cabinet and a part of the executive branch of the Federal Government. The major role of the cabinet is to infer from language of the opinion clause which is (Article II, section 2, Clause 1) of the Constitution of the United States which serves as an advisory board or body to the president of the United States. We live in an ever changing world. It is always going to be terrorist and terrorist attack on the United States, and as a unit or in unity our defense and home land security must train, prepare and prioritize in order to combat these attacks. Our power grids and infrastructure is terrorist number one target. The only recommendation I have for my city leaders concerning homeland security issues is prepare, plan, and strategize because we have several countries that do not like the United States of America. A good start would be to create scenarios and outcomes to help alleviate the stress and worry of not being prepared. We cannot afford to be uncovered and vulnerable. We should make it our life mission to stay one step ahead of terrorist. Please, use common sense and come up with creative ways to make the most of the monies available. Finally learn to use the resources we have no matter how limited they are.
